TAX CONTROVERSY AND LITIGATION

Offer in Compromise

The Offer in Compromise is a very exciting program for solving some tax problems. If you qualify, your tax debt may be settled for pennies on the dollar. While your Offer in Compromise is pending the IRS will suspend all collection activity including not filing further liens or levying on assets. In the event the Offer in Compromise is accepted, no additional liens will be filed or levies made while you make the payments. When the payments are complete the old liens will be dismissed.

The Offer in Compromise program may be a solution for you. But, merely submitting an Offer in Compromise is not enough. Even getting an Offer accepted is not enough. You must set up a PLAN to ensure that all current and future taxes are paid in full, and all future returns timely filed. Under an accepted Offer, you agree to comply with all provisions of the Internal Revenue Code relating to filing returns and paying the required taxes for at least 5 (five) years. Thus, if you fail to meet such requirements, the "back" tax obligations return.

Recent changes in the IRS requirements for filing an Offer in Compromise make it important to file your Offer correctly. Because of the nuances associated with completing and submitting the Offer the taxpayer usually does not possess the skill or knowledge of the IRS collection process necessary to make the best proposal for their benefit. Government statistics indicate as many as 75% of the Offers submitted first time are returned for lack of documentation or incorrect information. Of the remaining 25% processed generally less than 50% are compromised and settled for the taxpayer. We feel our success ratio is much greater and would like to assist you.

You may e-mail us at gcoulter@gctaxlawyer.com, contact us by going to and completing the Assistance Form, or call us at one of our phone numbers 1.888.5TAXLAW or 706.546.9755 or fax us at 706.546.1796.

A power of attorney is necessary for us to represent you before the IRS. You may download IRS Form 2848 and send it to us by completing lines 1 and 3, and executing it on line 9. Fax the form to us and mail the original.

Once we analyze your tax problem and you agree for us to represent you we send you an engagement letter by E-mail, fax or mail as you direct. When this is returned we will immediately start on your case.
